Website Information

We make reasonable efforts to keep the website accurate and current. However, website information is provided for general informational purposes and may not reflect every service limitation, site condition, product specification, price, or availability.

Website content is not a substitute for an on-site inspection, written estimate, service agreement, maintenance agreement, proposal, or professional evaluation.

Submitting a website form does not create a contract, guarantee an appointment, reserve a service date, or require Koster Irrigation to perform services.

Service Areas

Koster Irrigation provides services within selected areas of North Carolina, including Wilson, Goldsboro, Rocky Mount, Greenville, Zebulon, and Knightdale.

Service availability may vary according to property location, project type, scheduling, staffing, travel requirements, site conditions, and the scope of requested work. Contact us to confirm whether a particular property or project is within our current service area.

Service Requests and Communications

When submitting a service request, you agree to provide accurate and complete information, including:

  • Your name and contact information

  • The property address

  • Your company or organization, when applicable

  • A description of the problem or requested service

  • Relevant access, scheduling, and property information

  • Your authority to request work at the property

Submitting a request authorizes Koster Irrigation to contact you by telephone, email, or text message regarding your inquiry, inspection, estimate, appointment, account, or services.

Standard message and data rates may apply to text messages. Consent to receive marketing text messages is not a condition of purchasing services.

Estimates and Proposals

Unless expressly stated otherwise in writing, website information and initial discussions are not binding price quotes.

Estimates and proposals may be based on information available at the time they are prepared. Pricing, timelines, and recommended work may change if we discover conditions that were concealed, inaccessible, incorrectly described, or not reasonably identifiable during the initial evaluation.

Examples include:

  • Undocumented irrigation lines or utilities

  • Buried valves, wiring, piping, or obstructions

  • Damaged or inaccessible system components

  • Electrical, plumbing, drainage, or water-pressure problems

  • Changes in the requested scope of work

  • Property-access restrictions

  • Code, permit, inspection, or utility requirements

  • Conditions below ground or concealed by landscaping or structures

  • Manufacturer price changes or product availability

Additional work will require authorization as provided in the applicable estimate, change order, work order, or service agreement.

Separate Service Agreements

These Terms govern use of the website. Irrigation work may also be governed by a separate written document, including an estimate, proposal, contract, maintenance agreement, work order, warranty, or change order.

If a separate signed agreement conflicts with these website Terms, the signed agreement will control for the applicable services.

Customer Responsibilities

The customer or authorized property representative is responsible for:

  • Providing accurate property and system information

  • Confirming authority to approve the requested work

  • Providing safe and timely access to the property

  • Identifying known hazards, restrictions, and sensitive areas

  • Disclosing known private utilities and undocumented systems

  • Securing pets and providing appropriate access through gates or buildings

  • Obtaining owner, landlord, HOA, or management approval when necessary

  • Ensuring access to water, electrical service, controllers, valves, and system components

  • Reviewing and approving estimates, proposals, or change orders

  • Paying invoices according to the agreed terms

Delays, additional visits, or additional charges may result when access is unavailable or material property information was not disclosed.

Underground Utilities and Private Systems

Public utility-marking services may not identify privately installed utilities or irrigation components.

Unless private utility locating is included in a written scope of work, the customer is responsible for identifying and disclosing private systems such as:

  • Irrigation lines and control wiring

  • Landscape lighting

  • Private electrical lines

  • Septic systems

  • Drainage systems

  • Wells and water lines

  • Security, communications, or data wiring

  • Invisible pet fencing

  • Other privately installed underground features

Private utility locating reduces risk but does not guarantee that every underground component will be found. Soil conditions, depth, material type, damaged wiring, inaccurate records, and other site conditions may affect locating accuracy.

Scheduling and Delays

Appointments and anticipated completion dates are estimates unless expressly guaranteed in writing.

Scheduling may be affected by weather, emergencies, property access, material availability, manufacturer delays, permitting, inspections, utility coordination, staffing, unsafe conditions, or circumstances beyond our reasonable control.

We will make reasonable efforts to communicate significant scheduling changes.

Cancellations and Rescheduling

Please contact Koster Irrigation promptly if you need to cancel or reschedule an appointment.

Cancellation, trip, diagnostic, mobilization, restocking, or other charges may apply when disclosed in an estimate, service agreement, work order, or scheduling confirmation.

Pricing and Payment

Prices, deposits, payment schedules, accepted payment methods, late charges, and collection terms will be stated in the applicable estimate, invoice, proposal, work order, or service agreement.

Customers are responsible for reviewing charges and promptly reporting questions or billing concerns.

Failure to pay an amount when due may result in suspension of work, cancellation of future appointments, collection activity, or other remedies permitted by the applicable agreement and law.

Products and Replacement Parts

Product photographs, specifications, descriptions, and availability may change without notice.

When a specified product is unavailable, discontinued, delayed, or unsuitable for existing site conditions, Koster Irrigation may recommend a reasonably comparable alternative. Any material substitution affecting price or scope will be handled according to the applicable agreement or approval process.

Manufacturer warranties, when available, are governed by the manufacturer’s terms. Manufacturer warranty coverage does not necessarily include labor, diagnostics, travel, removal, reinstallation, shipping, or damage caused by site conditions.

Service Warranties

Any warranty covering Koster Irrigation’s labor or installed materials must be stated in writing in the applicable estimate, proposal, invoice, or service agreement.

Unless otherwise stated in writing, warranties do not cover problems caused by:

  • Freezing, storms, flooding, lightning, drought, fire, or other environmental events

  • Changes in water pressure or water supply

  • Landscaping, excavation, construction, utility, or property-management activity

  • Damage caused by third parties, vehicles, equipment, animals, roots, or pests

  • Misuse, neglect, vandalism, or unauthorized modifications

  • Existing defects or components outside the completed scope of work

  • Failure to perform recommended maintenance or winterization

  • Normal wear and tear

  • Manufacturer defects governed by a separate manufacturer warranty

Nothing in these Terms excludes a warranty or legal right that cannot lawfully be excluded.

Water Use and Landscape Results

Irrigation systems help manage water distribution, but landscape performance depends on factors beyond the irrigation system, including weather, soil, drainage, plant health, pests, disease, sunlight, maintenance practices, water restrictions, and property conditions.

Koster Irrigation does not guarantee a specific reduction in water use, utility expenses, plant growth, turf appearance, or landscape outcome unless that result is expressly guaranteed in a signed written agreement.

Customers remain responsible for complying with applicable watering restrictions and monitoring their properties for leaks, runoff, overspray, drainage problems, or abnormal water use.

Website Availability

We do not guarantee that the website will always be available, uninterrupted, secure, or error-free. We may update, suspend, restrict, or discontinue any part of the website without notice.

We are not responsible for delays or failures caused by hosting providers, internet-service providers, cyberattacks, software issues, maintenance, natural events, or circumstances outside our reasonable control.

Third-Party Websites and Services

The website may link to manufacturers, suppliers, payment processors, mapping services, social-media platforms, professional organizations, or other third parties.

Koster Irrigation does not control these third parties and is not responsible for their content, availability, security, products, services, or practices. Your use of a third-party website or service is governed by that party’s own terms and privacy policy.

Intellectual Property

The website and its original content—including text, graphics, photographs, designs, logos, icons, downloads, and page layouts—are owned by or licensed to Koster Irrigation and are protected by applicable intellectual-property laws.

You may view and print website content for personal or internal business use. You may not reproduce, modify, distribute, sell, license, publish, or commercially exploit website content without written permission.

Third-party names, products, trademarks, and logos remain the property of their respective owners.

Disclaimer of Website Warranties

To the fullest extent permitted by law, the website and its content are provided on an “as available” basis without warranties concerning accuracy, completeness, availability, fitness for a particular purpose, or freedom from errors or harmful components.

This disclaimer applies to the website and general website content. It does not replace or alter any express warranty included in a signed service agreement.

Limitation of Liability

To the fullest extent permitted by applicable law, Koster Irrigation will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from your use of—or inability to use—the website.

This limitation does not apply where liability cannot lawfully be limited. Rights and remedies relating to contracted irrigation services will be governed by the applicable service agreement and applicable law.

Indemnification

To the extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful misuse of the website, your material violation of these Terms, or information you submit without proper authority.

This provision does not require you to indemnify Koster Irrigation for its own unlawful conduct, negligence, or obligations that cannot legally be transferred.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Any dispute relating solely to website use will be handled by a court with appropriate jurisdiction in North Carolina, unless the parties agree to another lawful resolution method.

Any separate service agreement may contain additional dispute-resolution, venue, or governing-law terms.

Changes to These Terms

We may update these Terms when our website, services, business practices, or legal obligations change.

The updated Terms will be posted on this page with a revised effective date. Changes will apply prospectively from the date they are posted unless otherwise required by law.

Severability

If a provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.

No Waiver

A failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

Entire Agreement for Website Use

These Terms and the Privacy Policy constitute the agreement between you and Koster Irrigation concerning use of this website.

They do not replace a signed estimate, proposal, work order, maintenance agreement, contract, warranty, or other agreement governing irrigation services.
